All construction projects come with an element of risk – it’s when that risk starts to escalate that you may need to call upon our expert team. We will take the time to understand your brief, wider strategic interests and goals. As claims and commercial specialists, with many years of lessons learnt on a diverse range of projects, we endeavor to eliminate risk within your project from the onset.

The Claims Management team are here to reduce and mitigate that risk throughout the project life-cycle. We ensure complex contractual issues are properly managed and aim to add value to your business, by maximising your commercial position.

We analyse your problem from the outset and provide a concise plan of action, providing you with the confidence that any dispute is handled as quickly and efficiently as possible.

Pre-Construction

  • We prepare cost plans and budgets, and provide extensive knowledge of risks for cost growth, etc
  • We prepare and implement commercial procedures
  • We provide tender evaluations, including sensitivity analysis, etc
  • We offer subcontract drafting (project specific schedules) and negotiation
  • We provide assistance with value engineering and other strategic decisions on project execution

Construction phase

  • We manage contracts and subcontracts, including measurement of work, interim valuations (ensuring compliance with payment provisions of the contract/construction act), valuation of scope changes, assessment of validity and value of claims for extensions of time/additional cost recovery, cost forecasting and reporting (early warning), etc
  • We draft carefully worded letters in cases where contractual differences or disputes arise in order to ensure that position under the contract is properly administered and that rights are reserved at all times (avoidance of waiver arguments, etc)
  • We offer advice on key strategic decisions, for example, benefits/risks in connection with mitigation/acceleration measures, contract amendments, sectional take over, defects rectification, etc
  • We offer advice and assistance in relation to dispute avoidance or proceedings

Post construction phase

  • We draft final account preparation and negotiation agreement
  • We offer advice and assistance in relation to dispute avoidance or proceedings

Other services

  • We offer NEC 3/4 compliance audits, training and support to our clients
  • We have expert knowledge of the NAECI, including principles and application of all the constituent parts of labour rate calculations, incentive bonus arrangements, working hours and the like

  • We prepare independent reports, prospects reports and the like on quantum issues
  • We have the ability to analyse and establish the true causes of delay by means of high level review or forensic critical path analysis using windows or time impact analysis techniques with software such as Primavera and Microsoft Project
  • We prepare other ad hoc reports where forensic investigation is required
  • We have extensive experience in adjudication, mediation, litigation and arbitration proceedings, ranging from quantum advice to drafting of full pleadings, witness statements and the like, utilising acquired knowledge of latest legal developments.
